2. About these terms
These terms apply when you:
-
use this website;
-
place an order through the website; or
-
purchase a product from us through another method where these terms are provided to you.
Please read them before placing an order.
Our Privacy Policy, Cookie Policy, Delivery and Returns Policy, and Shipping & Delivery Policy also apply where relevant.
If you are purchasing on behalf of a company or another organisation, you confirm that you have authority to place the order on its behalf.
3. Information on the website
We take reasonable care to ensure that the information on our website is clear, accurate and up to date.
Product photographs are for illustration. There may be minor differences in colour, packaging or branding between the photographs and the products supplied.
Where necessary, we may replace an individual item with an appropriate alternative where its purpose and specification are not materially reduced. We will not make a material change to the contents of an order without notifying you.
Product availability may change, and information on the website does not guarantee that a product will remain available.
4. The Emergency CORE Bag
The Emergency CORE Bag is designed to bring together emergency and first-aid equipment in a clear and accessible system.
It is intended to support an initial emergency response while professional assistance is being arranged or is on its way. It does not replace:
-
calling the emergency services where required;
-
professional medical assessment or treatment;
-
appropriate first-aid training;
-
a workplace first-aid needs assessment;
-
appropriate workplace policies and emergency procedures; or
-
any legal health and safety responsibilities applying to the purchaser or the workplace.
The appropriate equipment, quantities, trained personnel and emergency arrangements will depend on the nature of the workplace, its location, the number of people present and the risks involved.
The purchaser is responsible for deciding whether the Emergency CORE Bag and its contents are appropriate and sufficient for the environment in which they will be used.
5. Safe use, inspection, and maintenance
Products must be used in accordance with the instructions, warnings and information where supplied. The purchaser is responsible for:
-
making the bag accessible to the people who may need it;
-
ensuring that relevant personnel know where it is and how to access it;
-
ensuring that products are used only by people with appropriate knowledge or training where this is required;
-
storing the bag and its contents appropriately;
-
inspecting the contents regularly;
-
replacing anything that has been used, opened, damaged or contaminated; and
-
monitoring and replacing items before or when they expire.
Do not use an item if its packaging or seal has been damaged, if it has expired, or if there is any reason to believe it may no longer be safe or suitable for use.
The manual and other general information supplied with the bag do not constitute personalised medical advice.
6. Business and organisational customers only
The Emergency CORE Bag is supplied only to businesses, charities, public bodies, other organisations and individuals purchasing wholly or mainly for purposes connected with their trade, business, craft or profession.
We do not currently accept orders placed wholly or mainly for personal or household use.
By placing an order, you confirm that:
-
the purchase is being made for business, professional or organisational purposes;
-
you are not purchasing as a consumer for personal or household use; and
-
you have authority to place the order on behalf of the named business or organisation, where applicable.
We may contact you to verify the nature of an order and may decline or cancel an order where we reasonably believe it has been placed for personal or household use.
7. Placing an order
Please check your order carefully before submitting it, including the product selected, quantities, delivery address and contact details.
After you submit an order, we will send you an acknowledgement. This confirms that we have received the order but does not necessarily mean that it has been accepted.
A contract is formed when we send you confirmation that the order has been accepted and dispatched.
We may be unable to accept an order because:
-
a product is unavailable;
-
payment could not be authorised;
-
we cannot deliver to the address provided;
-
we have identified an error in the price or product information;
-
the quantity ordered is subject to a limit; or
-
we reasonably suspect fraud, misuse or another unlawful activity.
If payment has already been taken for an order that we cannot accept, we will refund it.
8. Prices and payment
Prices are shown in pounds sterling.
We are not currently registered for VAT and do not charge VAT.
Delivery charges and any other applicable charges will be shown before you place your order.
Payment must be made using one of the payment methods offered at checkout. You confirm that you are authorised to use the payment method provided.
We may change our prices at any time, but a change will not affect an order that we have already accepted.
If we discover an obvious pricing error before accepting an order, we will contact you and give you the choice of proceeding at the correct price or cancelling the order.
9. Delivery
Available delivery locations, charges and estimated timescales will be provided before the order is confirmed.
Delivery dates are estimates unless we have expressly agreed a fixed delivery date with you.
We are not responsible for delays caused by circumstances outside our reasonable control, but we will contact you if a significant delay becomes known to us.
You are responsible for providing a complete and accurate delivery address and for ensuring that someone can receive the order where necessary.
Please inspect the order as soon as reasonably possible after delivery and contact us promptly if anything is missing or appears to have been damaged in transit.
Responsibility for the products passes to you when they are delivered to the address provided in your order.
10. Cancellations and change-of-mind returns
The Emergency CORE Bag is supplied only to business and organisational customers. We do not accept orders from individuals purchasing wholly or mainly for personal or household purposes.
If you wish to cancel an order, you must contact us as soon as possible and no later than 24 hours after placing it.
We will make reasonable efforts to stop the order before it is prepared or dispatched, but cancellation is not guaranteed.
Where we accept a cancellation before delivery costs have been incurred, we will refund the full amount paid.
Where packaging, carrier booking, collection or other delivery costs have already been incurred, those costs are non-refundable. We will refund the price paid for the Emergency CORE Bag and any delivery charges that we are able to recover from the carrier.
Once an order has been dispatched, there is no automatic right to cancel or return it because you have changed your mind.
We may agree to accept a return at our discretion. Any agreed return must be:
-
authorised by us in advance;
-
complete, unused and in its original condition;
-
securely packaged; and
-
returned within the period specified by us.
The customer will be responsible for all return delivery costs.
Original delivery charges are non-refundable once the order has been dispatched. Where we accept a change-of-mind return, the refund will be limited to the price paid for the returned Emergency CORE Bag, subject to inspection.
We may reduce or refuse a refund where products are incomplete, opened, used, damaged, contaminated, expired, altered or otherwise unsuitable for resale.
This section does not affect any rights available where products are faulty, damaged in transit, incorrectly supplied or not as described.
11. Faulty, damaged, or incorrectly supplied products
Please contact us at emergencycorebag@outlook.co.uk as soon as reasonably possible if a product:
-
arrives damaged;
-
is incomplete;
-
is not what you ordered;
-
is faulty;
-
is not as described; or
-
presents a potential safety concern.
We may ask for photographs, the product batch or reference number, details of the issue and proof of purchase so that we can investigate.
Depending on the circumstances and your legal rights, we may offer a repair, replacement, refund or another appropriate solution.
Nothing in these terms limits your statutory rights.
12. Product safety concerns and recalls
You must stop using an item immediately if you become aware of a possible defect or safety risk.
Please report any safety concern or incident involving a product supplied by us to [product safety email address], providing as much information as possible.
Where we become aware of a product safety issue, we may contact customers with instructions, safety information or details of a corrective action or recall. You must follow any reasonable safety or recall instructions that we provide.
13. Our responsibility
We do not guarantee that the presence or use of the Emergency CORE Bag will prevent an injury, prevent a condition from worsening or produce a particular medical outcome.
We are not responsible for loss or harm to the extent that it is caused by:
-
incorrect or inappropriate use;
-
failure to follow the instructions or warnings supplied;
-
use of an expired, damaged, opened or contaminated product;
-
failure to inspect, maintain or replenish the contents;
-
unauthorised alteration of a product;
-
use in an environment for which the product is unsuitable; or
-
a failure to obtain appropriate medical or emergency assistance.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
If you are purchasing for business purposes, we will not be responsible for indirect or consequential loss, or for loss of profit, revenue, business opportunity, anticipated savings or goodwill.
Nothing in these terms excludes or limits liability for:
-
death or personal injury caused by negligence;
-
fraud or fraudulent misrepresentation;
-
a defective or unsafe product where liability cannot lawfully be excluded;
-
your statutory consumer rights; or
-
any other liability that cannot legally be excluded or limited.
